1. Acceptance of Terms

By accessing or using HirePost (available at hire-post.com and hirepost.polsia.app), you agree to be bound by these Terms of Service and all policies incorporated by reference. If you do not agree, do not use HirePost.

These Terms apply to all users: business owners ("Employers") who create accounts and post jobs, and job applicants ("Applicants") who submit applications through employer-hosted job boards. By using HirePost on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. What HirePost Offers

HirePost operates as two distinct service types. These Terms apply to both, and certain sections apply specifically to one or the other.

SaaS Software Platform

A subscription-based software platform ($29/mo, $59/mo, or $99/mo plans) providing:

  • Job posting and applicant tracking system (ATS)
  • Social media post scheduling tools
  • Employee onboarding and training management
  • Embeddable job board widget for your website
  • Analytics and reporting dashboard

Services Expert Consulting Services

Hands-on professional services including:

  • Recruiting packages ($299 – $1,999 per engagement)
  • Dedicated recruiter retainer ($999/mo)
  • HR consulting, onboarding setup, and training development

Expert Services are governed by the additional terms in Section 4 and the separate statement of work or intake form provided at the time of purchase.

3. SaaS Platform License

Grant of License

Subject to your payment of subscription fees and compliance with these Terms, HirePost grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for your internal business purposes.

No Ownership Transfer

You are purchasing a subscription to use the software — not ownership of the software or any intellectual property within it. HirePost retains all rights, title, and interest in the platform, including all improvements and derivative works.

Restrictions

You may not:

  • Resell, sublicense, or provide access to the platform to third parties outside your organization
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the platform to build a competing product or service
  • Scrape, crawl, or harvest data from the platform in automated ways not sanctioned by HirePost
  • Use the platform for any unlawful purpose or in violation of any applicable law

Availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance, infrastructure outages, or events beyond our control may cause temporary downtime. We will make reasonable efforts to notify you of planned outages.

4. Consulting & Expert Services

When you purchase Expert Services (recruiting packages, HR consulting, training development), the following terms apply in addition to the general Terms:

Scope & Deliverables

The specific deliverables, timelines, and pricing for each engagement are defined in the intake form or service description at the time of purchase. HirePost will use reasonable professional efforts to deliver the agreed scope. Significant changes to scope requested after purchase may require additional fees.

Your Cooperation

Expert Services may require you to provide timely information, approvals, access, or feedback. Delays caused by your failure to cooperate may affect delivery timelines without entitling you to a refund.

Confidentiality

Both parties agree to treat non-public business information shared during an Expert Services engagement as confidential and not to disclose it to third parties without prior written consent, except as required by law.

Results Not Guaranteed

HirePost cannot guarantee specific outcomes from consulting services (e.g., a specific number of qualified candidates, a specific time-to-hire, or specific employee performance after training). We commit to professional-quality effort, not guaranteed results.

5. User Responsibilities

Accurate Job Postings

You are solely responsible for ensuring that job postings you create are accurate, truthful, and comply with all applicable employment laws. You must not post fake, misleading, or discriminatory job listings. HirePost reserves the right to remove any job posting that violates these requirements.

Lawful Use

You agree to use HirePost only for lawful purposes and in compliance with all applicable federal, state, and local employment laws, including but not limited to equal employment opportunity (EEO) laws, the Americans with Disabilities Act (ADA), the Fair Credit Reporting Act (FCRA) if conducting background checks, and applicable state hiring laws.

Account Security

You are responsible for maintaining the security of your account credentials. You must notify us immediately at admin@hire-post.com if you suspect unauthorized access. You are responsible for all activity that occurs under your account.

Applicant Treatment

You agree to treat applicants fairly and in compliance with applicable anti-discrimination laws. HirePost is a platform tool — hiring decisions are entirely your responsibility.

6. Data Handling

Applicant Data

When applicants submit applications through your HirePost-powered job board, their personal information (name, email, phone, resume links, cover letters) is stored in your account. You are the data controller for applicant information and are responsible for handling it in accordance with applicable privacy laws.

Your Business Data

Job posting content, social media drafts, onboarding materials, and training content you create in HirePost remain your property. We process this data solely to provide the service.

Social Media Credentials

If you connect social media accounts to HirePost for scheduling, we store OAuth tokens required to post on your behalf. We do not use these credentials for any purpose other than executing scheduled posts you create.

Data Security

We use industry-standard security measures including encrypted connections (HTTPS), encrypted storage of sensitive tokens, and parameterized database queries. No security measure is 100% foolproof, and we cannot guarantee absolute security of your data.

7. Payment & Billing

SaaS Subscriptions

Subscription fees are billed monthly in advance. Prices are as listed on the Pricing page at the time of subscription. We reserve the right to change pricing with 30 days' notice to active subscribers.

Expert Services

Expert Services are priced per the service package at the time of purchase. Payment terms (deposit, milestone, or full payment upfront) are specified in the checkout flow for each service.

Taxes

Prices do not include applicable taxes. You are responsible for any sales tax, VAT, or similar taxes applicable to your purchases.

8. Independent Contractor Clause

HirePost is not an employer of record, staffing agency, or professional employer organization (PEO). We provide software tools and consulting services to help you manage your hiring and HR workflows. We do not employ, place, or co-employ any workers on your behalf. Any individuals you hire through HirePost are your employees or contractors — not HirePost's.

Any HirePost personnel who provide Expert Services do so as independent contractors or employees of HirePost, not as your employees. They are not entitled to your employment benefits and are not subject to your employment policies.

You are solely responsible for all employment decisions, employment taxes, workers' compensation, and compliance with employment laws for your workforce.

9. Limitation of Liability

Disclaimer of Warranties

THE HIREPOST PLATFORM AND EXPERT SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIREPOST'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO HIREPOST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) $100.

Exclusion of Consequential Damages

HIREPOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, REGARDLESS OF THE CAUSE OF ACTION AND WHETHER ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify and hold HirePost harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your job postings or hiring decisions; or (d) your violation of any third-party rights.

10. Termination & Suspension

By You

You may cancel your subscription at any time through your account settings or by contacting admin@hire-post.com. Cancellation takes effect at the end of the current billing period. See our Refund Policy for details.

By HirePost

We may suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms or any applicable law
  • You post fraudulent, discriminatory, or otherwise unlawful job listings
  • You fail to pay fees when due
  • We reasonably believe your account poses a security risk to the platform or other users

Effect of Termination

Upon termination, your access to the platform ceases. We will retain your data for 30 days post-termination, after which it may be deleted. You may request a data export prior to termination by emailing admin@hire-post.com.

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles.

Informal Resolution First

Before filing any legal claim, you agree to contact us at admin@hire-post.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If informal resolution fails, disputes shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration.

Small Claims Exception

Either party may bring a claim in small claims court in Mobile County, Alabama, if the claim qualifies under that court's rules.

12. Changes to Terms

We may update these Terms from time to time. We will notify active subscribers via email at least 14 days before material changes take effect. Your continued use of HirePost after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must cancel your account before the effective date.
